1. The  Master  Commissioner  will  sell  same  at  public  auction  to  the  highest  and best  bidder  at  the  Courthouse  door  for  cash  in full or  a  cash deposit  of  10%  of  the  purchase price  with  the balance on credit for thirty (30) days, except that said deposit be waived if the Plaintiff is the successful bidder. The Purchaser shall take the real estate free and clear of the claims of the parties to this action, including the additional interest of the Plaintiff in the mortgage recorded on September 29, 2005 in Book 161 at Page 155, and all liens and/or interests arising by virtue of instruments which are recorded in the Crittenden County Clerk’s Office, or otherwise arise, after the recording of the Plaintiff’s Lis Pendens notice, but the property shall be sold subject to the following, for which the purchaser shall not have a credit against the purchase price:
a. All state, county and city real estate taxes not yet due and owing at the time of sale;
b. Easements, restrictions and stipulations of record;
c. Assessments for public improvements levied against the property; and
d. Any facts which an inspection and accurate survey of the property may disclose.
The purchaser shall be required to assume and pay any ad valorem taxes and all taxes assessed against said property by  any  City, State, County or  any  school  district  which  are due and payable at any time during the year 2012 and thereafter. Said property shall be sold with the improvements thereon “as is” and is indivisible and cannot be divided.
4. Pursuant to the aforementioned Default Judgment, the successful bidder, their own expense, carry fire and extended insurance coverage on those insurable improvements included in the real estate described herein from the date of the sale until the purchase price is fully paid, to the extent of the Court appraised value of said improvements or the unpaid balance of the purchase price, whichever is less, as a minimum, with a loss payable clause to the Commissioner of the Crittenden Circuit Court or the Plaintiff herein. Failure of the purchaser to effect such insurance shall not affect the validity of the sale or the purchaser’s liability thereunder, but shall entitle, but not require, the Plaintiff to effect said insurance and furnish the policy and the premium thereof or the proper portion thereof shall be charged to the purchaser as Purchaser’s costs. 
5. The purpose of this sale is the satisfaction of a Default Judgment entered on April 12, 2012 on behalf of the Plaintiff against the Defendant, Stella Mae Holloman, for the following sums as of February 21, 2012:

Interest from 9/1/2010 through 2/21/2012   $2,373.54
Advancements for the property:

-Insurance: $1,079.52
Inspections: $135.35

Plus interest at the current rate of 7.12500% ($4.37) per diem from the above date until paid plus advances for taxes and insurance, and its costs expended herein, including a reasonable attorney fee and for any other fees expended for services performed in connection with the Defendant’s default and for protecting Plaintiff’s interest in the property and its rights under the mortgage instrument.
6. In afore-mentioned Default Judgment, entered April 12, 2012, the Plaintiff was granted a first mortgage lien against the real estate described above together with all improvements thereon, appurtenances thereto belonging, and the rent, issues and profits thereof. Plaintiff’s lien is to be prior and superior to the interests of Stella Mae Holloman and/or the unknown spouse of her in the subject real estate property and the real property shall be sold free and clear of any interest of said Defendants, except any lien for city, county and state ad valorem taxes asserted in this action.
7. The Plaintiff, the Court and the Master Commissioner shall not be deemed to have warranted title to any purchaser.
8. Prior to the sale the real estate herein shall be appraised by two (2) disinterested, intelligent housekeepers of Crittenden County, Kentucky who shall report their appraisals in writing.
9. The sale of the property herein shall be withdrawn immediately if directed to be done at any time prior to the commencement of bidding at the sale by the attorney for the Plaintiff or any member of the office staff of the attorney for the Plaintiff, regardless of whether said direction be made in writing or orally, by telephone or other means. 
10. Plaintiff may submit a specified bid by facsimile to the office of the Master Commissioner prior to the sale.
11. The proceeds of the sale, or a sufficiency thereof, shall be applied to the following items in the order of priority:
a. To the costs of the sale, including all Commissioner’s costs;
b. To the payment of all City and/or County real estate taxes which are due and owing at the time of the sale;
c. To the full satisfaction of the judgment in favor of the Plaintiff set forth in paragraph five (5) of this Notice, including reimbursement of its costs, expenses and attorney fees as set forth therein;
d. To the full satisfaction of any  junior liens on the real estate in the same priority that they held on the real estate; and
e. The balance of the sale proceeds, if any, shall be held by the Commissioner of this Court until further Orders of this Court.
12. The purchaser of the real estate is entitled to possession of the real estate upon confirmation of the sale by the Court.
13. Upon confirmation the Master Commissioner shall issue a Deed conveying the interests of the Defendants in the subject property to the successful purchaser.

4. Said Judgment also grants Plaintiff a lien on the real estate described herein, together with all improvements on the real estate, including the principal place of residence, and appurtenances related to it, and the rents, issues and profits thereon. Further, said Judgment provides that Plaintiff’s lien be prior and superior to the lien of each of the Defendants, except any lien for city, county, and state ad valorem taxes asserted in this action. Plaintiff’s lien is to be prior and superior to the interests of Paul T. Buchanan aka Paul Travis Buchanan and Rhodenia D. Buchanan aka Rhondenia Denise Buchanan and/or the unknown spouses of the afore-named Defendants in the real property described herein. The said property shall be sold free and clear of any interest of the said Defendants.
5. The Plaintiff, the Master Commissioner and the court shall not be deemed to have warranted title of the real estate to the purchaser.
6. The real estate is indivisible and cannot be divided without materially impairing its value and the value of Plaintiff’s lien thereon. The real estate shall be sold as a whole for the purpose of satisfying the Judgment Liens herein adjudged against the real estate. 
7. The real estate will be appraised, under oath, by two disinterested, intelligent housekeepers of the county pursuant to KRS 426.200.
8. Pursuant to CR 53.02(1), a copy of this Notice shall be sent via ordinary mail upon every party who is not in default for failure to appear.

In the event Plaintiff is the successful purchaser, Plaintiff shall be entitled to a credit upon the Default Judgment without making the cash deposit or executing the sale bond as described above and shall only be obligated to pay the Court costs, fees and costs of  the Master Commissioner  and any  delinquent  real  estate  taxes  payable  pursuant  to  the Order of Sale.  
 2. If the purchaser shall cause default of the deposit or  posting of bond, the Master Commissioner shall immediately resell the property upon the same terms and conditions set out herein.
 3. The Purchaser shall take the real estate free and clear of the claims of the parties to this action, including the additional interest of the Plaintiff in the mortgage recorded on September 29, 2005 in Book 161 at Page 155, and all liens and/or interests arising by virtue of instruments which are recorded in the Crittenden County Clerk’s Office, or otherwise arise, after the recording of the Plaintiff’s Lis Pendens notice, but the property shall be sold subject to the following, for which the purchaser shall not have a credit against the purchase price:
  a.  All state, county and city real estate taxes not yet due and owing at the time of sale;
  b. Easements, restrictions and stipulations of record;
  c. Assessments for public improvements levied against the property; and
  d. Any facts which an inspection and accurate survey of the property may disclose.
The purchaser shall be required to assume and pay any ad valorem taxes and all taxes assessed against said property by  any  City, State, County or  any  school  district  which  are due and payable at any time during the year 2012 and thereafter. Said property shall be sold with the improvements thereon “as is” and is indivisible and cannot be divided.
 4. Pursuant to the aforementioned Default Judgment, the successful bidder, their own expense, carry fire and extended insurance coverage on those insurable improvements included in the real estate described herein from the date of the sale until the purchase price is fully paid, to the extent of the Court appraised value of said improvements or the unpaid balance of the purchase price, whichever is less, as a minimum, with a loss payable clause to the Commissioner of the Crittenden Circuit Court or the Plaintiff herein. Failure of the purchaser to effect such insurance shall not affect the validity of the sale or the purchaser’s liability thereunder, but shall entitle, but not require, the Plaintiff to effect said insurance and furnish the policy and the premium thereof or the proper portion thereof shall be charged to the purchaser as Purchaser’s costs. 
 5. The purpose of this sale is the satisfaction of a Default Judgment entered on April 12, 2012 on behalf of the Plaintiff against the Defendant, Stella Mae Holloman, for the following sums as of February 21, 2012:
Principal: $27,129.86
Interest from 9/1/2010 through 2/21/2012 $2,373.54
Advancements for the property:
 -Taxes: $961.65
 -Insurance: $1,079.52
Inspections: $135.35
Property Maintenance: $705.00
BPO/Appraisal: $250.00
Late Charges: $23.85
TOTAL: $32,658.77

Plus interest at the current rate of 7.12500% ($4.37) per diem from the above date until paid plus advances for taxes and insurance, and its costs expended herein, including a reasonable attorney fee and for any other fees expended for services performed in connection with the Defendant’s default and for protecting Plaintiff’s interest in the property and its rights under the mortgage instrument.
 6. In afore-mentioned Default Judgment, entered April 12, 2012, the Plaintiff was granted a first mortgage lien against the real estate described above together with all improvements thereon, appurtenances thereto belonging, and the rent, issues and profits thereof. Plaintiff’s lien is to be prior and superior to the interests of Stella Mae Holloman and/or the unknown spouse of her in the subject real estate property and the real property shall be sold free and clear of any interest of said Defendants, except any lien for city, county and state ad valorem taxes asserted in this action.
 7. The Plaintiff, the Court and the Master Commissioner shall not be deemed to have warranted title to any purchaser.
 8. Prior to the sale the real estate herein shall be appraised by two (2) disinterested, intelligent housekeepers of Crittenden County, Kentucky who shall report their appraisals in writing.
 9. The sale of the property herein shall be withdrawn immediately if directed to be done at any time prior to the commencement of bidding at the sale by the attorney for the Plaintiff or any member of the office staff of the attorney for the Plaintiff, regardless of whether said direction be made in writing or orally, by telephone or other means. 
 10. Plaintiff may submit a specified bid by facsimile to the office of the Master Commissioner prior to the sale.
 11. The proceeds of the sale, or a sufficiency thereof, shall be applied to the following items in the order of priority:
  a. To the costs of the sale, including all Commissioner’s costs;
  b. To the payment of all City and/or County real estate taxes which are due and owing at the time of the sale;
  c. To the full satisfaction of the judgment in favor of the Plaintiff set forth in paragraph five (5) of this Notice, including reimbursement of its costs, expenses and attorney fees as set forth therein;
  d. To the full satisfaction of any  junior liens on the real estate in the same priority that they held on the real estate; and
  e. The balance of the sale proceeds, if any, shall be held by the Commissioner of this Court until further Orders of this Court.
 12. The purchaser of the real estate is entitled to possession of the real estate upon confirmation of the sale by the Court.
 13. Upon confirmation the Master Commissioner shall issue a Deed conveying the interests of the Defendants in the subject property to the successful purchaser.

Case Manager:  The Pennyrile Area Agency on Aging has a contract opportunity for a case manager in Crittenden and Livingston Counties. This position is a Personal Service Contract with the Pennyrile Area Development District (PADD). Duties will include providing assessment/case management services to determine the client’s eligibility for in home services.  Provide in home visits every other month. Maintain necessary documentation. Develop plan of care and ensure referrals are made for needed services.
